ALL SUBSCRIPTION FEES ARE NON-REFUNDABLE. Once you have been charged for a subscription period, you will not receive a refund, even if you:

14. Governing Law & Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law principles.

14.2 Jurisdiction

Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Pretoria, Gauteng, South Africa. You irrevocably consent to the jurisdiction and venue of these courts.

14.3 Informal Dispute Resolution (Mandatory First Step)

Before filing any legal action, you must attempt to resolve any disputes informally by:

14.4 Class Action Waiver

YOU EXPRESSLY WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE PROCEEDINGS. You agree to bring any claims against Vaultneur on an individual basis only.

14.5 Time Limitation on Claims

YOU MUST BRING ANY CLAIM AGAINST VAULTNEUR WITHIN ONE (1) YEAR OF THE DATE THE CAUSE OF ACTION ARISES. Any claim not filed within this period is permanently barred.

14.6 No Jury Trial

YOU WAIVE YOUR RIGHT TO A JURY TRIAL. Any litigation shall be decided by a judge, not a jury.

14.7 Injunctive Relief

Notwithstanding the foregoing, Vaultneur may seek injunctive or equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement or violation of our intellectual property rights or these Terms.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes:

19. User Acknowledgment & Acceptance

BY CREATING AN ACCOUNT, ACCESSING, OR USING THE SERVICE IN ANY MANNER, YOU EXPRESSLY ACKNOWLEDGE, AGREE, AND REPRESENT THAT:

  2. You have read and understood the Privacy Policy and Refund Policy
  3. You understand that Mindelyx is an AI-powered service and all responses are generated by artificial intelligence
  4. You acknowledge that Vaultneur has no control over AI-generated content and accepts no responsibility for its accuracy, safety, or appropriateness
  5. You agree that you will not rely on AI-generated content as professional advice (medical, legal, financial, etc.)
  6. You understand that all subscription fees are non-refundable except as explicitly stated in the Refund Policy
  7. You agree to the limitation of liability, disclaimers, and indemnification obligations
  8. You waive your right to participate in class actions or jury trials
  9. You agree that any claims must be brought within one year or be forever barred
  10. You accept all risks associated with using AI-generated content
  11. You are of legal age and capacity to enter into a binding contract
  12. If you do not agree to any provision of these Terms, you will not use the Service

YOUR CONTINUED USE OF THE SERVICE CONSTITUTES ONGOING ACCEPTANCE OF THESE TERMS, INCLUDING ANY MODIFICATIONS.
